Judiciary system of India

 * Judiciary system is an important organ of the government.

* Right from 1950 , the judiciary has played an important role in interpreting and in protecting the Constitution.

* The Supreme Court of India is in fact one of the very powerful courts in the world.


Why do we need an independent Judiciary ?

* In a society , there must be disputes between individuals , between groups and between individuals or groups and government.

* All such disputes must be settled by an independent body i.e. Judiciary.

Independence of Judiciary

* Executive and Legislature must not restrain the functioning ...---should not interfere with the decision of the judiciary.

* Judges must be able to perform their functions without fear and favour.

* Independence doesn't imply arbitrariness or absence of accountability.

*Because of a part of democratic political structure of the country----accountable to the Constitution , democratic traditions and people of the country.

* Judges have fixed tenure --- hold office till the age of retirement ---- ensures that judges could functions without fear and favor .

* Makers of Constitution believed that a difficult procedure of removal would provide security of office to the members of  Judiciary.

* Judiciary is not financially dependent on either the executive or the legislature.

* No one can criticise the actions of the judges.

* If any one found guilty of contempt of court , judiciary has the power to penalise them .

* Parliament can discuss the conduct of judges only when the removal of judges is in proceeding.
